SHESAID TERMS OF SERVICE

Australia • Customer-Facing Terms of Service
Effective date: 23 September 2026

Your agreement with SheSaid

These Terms of Service explain the rules that apply when you use the SheSaid website or purchase products from us.

They are intended to provide clear and practical terms for Australian customers and must be read together with your rights under the Australian Consumer Law (ACL).

Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified.

1. About These Terms

In these Terms, “SheSaid”, “we”, “us” and “our” refer to SheSaid and the business operating the SheSaid online store.

“You” and “your” refer to the customer or website user.

These Terms apply to your use of the SheSaid website at https://shesaid.online/ and to purchases made through the website.

The following policies may also apply to your use of our website or a particular purchase:

  • Refund & Returns Policy
  • Shipping & Delivery Policy
  • Privacy Policy
  • Warranty & Product Guarantee Policy
  • Promotions / Discounts Policy
  • Any additional terms stated with a particular product, promotion or service

These Terms are intended for customers in Australia and must be read consistently with the Australian Consumer Law and other laws applicable to your transaction.

2. Using the Website

You may use the website only for lawful purposes and in accordance with these Terms.

You must not:

  • misuse the website or interfere with its operation;
  • attempt unauthorised access to the website, accounts, systems or security features;
  • introduce viruses, malware or other malicious code;
  • use the website in a way that could damage SheSaid, our customers or service providers;
  • impersonate another person or provide false or misleading information;
  • use the website to harass, abuse, threaten or harm another person;
  • use the website to engage in unlawful activity;
  • copy, scrape or systematically extract website content without our written permission;
  • use automated tools, bots, spiders or other automated processes to access or extract website content in a manner that interferes with the operation of the website or circumvents our access controls.

We may suspend or restrict access where reasonably necessary to protect the website, customers, payment systems or our business from misuse, fraud, security threats or other harmful activity.

Any suspension or restriction will not affect rights you have under applicable law.

3. Accounts and Customer Information

Some features of our website may allow you to create or use a customer account.

Where you create an account, you are responsible for providing information that is accurate, current and complete and for keeping your account credentials secure.

You must not share your password or other account credentials with another person or allow another person to use your account in a way that could compromise its security.

Please contact us promptly if you believe your account or account credentials have been accessed or used without your authorisation.

We may suspend or restrict an account where reasonably necessary for security, fraud prevention, misuse or other legitimate operational reasons, subject to applicable law.

4. Products and Product Information

We aim to keep product names, descriptions, images, ingredients, directions, warnings, specifications and other website information accurate and current.

Product images are provided for illustration. Products, packaging, colours or appearance may vary slightly from images displayed on your device where the difference is not material.

Product information may be updated from time to time.

We may discontinue products or limit quantities where reasonably necessary, subject to applicable law.

You should carefully read the product description, ingredients, directions and warnings before purchasing and using a product.

If you have allergies, sensitivities, skin concerns or other relevant considerations, you should assess whether the product is suitable for you before use.

Beauty and cosmetic products may produce different results for different people. Unless expressly stated otherwise, product information is not medical advice and should not be treated as a diagnosis or treatment recommendation.

5. Product Safety and Adverse Reactions

SheSaid takes product safety seriously.

Beauty and cosmetic products may cause an adverse reaction, sensitivity or allergic reaction in some individuals, and individual responses can vary.

Please carefully review the ingredients, directions, warnings and other product information before purchasing and using a product, particularly if you have known allergies, sensitivities or other relevant concerns.

If you experience an unexpected or serious reaction, stop using the product and seek appropriate medical assistance.

Please contact SheSaid as soon as reasonably practicable so that we can assess the issue and take any appropriate safety action.

Nothing in these Terms excludes, restricts or modifies any right or remedy available under the Australian Consumer Law.

6. Prices, Payments and Taxes

Prices are displayed in Australian dollars unless otherwise stated.

The total amount payable will be shown at checkout before payment is submitted.

Payment must be made using the payment methods available at checkout.

Payment information may be processed by third-party payment providers, which may have their own terms and privacy practices.

If an obvious pricing, product or promotional error occurs, we may contact you before accepting the order to confirm whether you wish to proceed at the correct price or cancel the order and receive a refund of any amount paid.

Any applicable taxes, customs or import charges will be handled in accordance with the applicable transaction and delivery arrangements. Where a charge is applicable and we are required to disclose it before payment, we will do so.

7. Orders and Acceptance

When you submit an order, you are requesting to purchase the selected products.

An order confirmation email confirms that we have received your order but does not necessarily mean that the order has been accepted.

A contract for the purchase of products is formed when SheSaid accepts the order or otherwise confirms that the order has been accepted for processing.

We may decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • there is a material pricing or listing error;
  • payment cannot be authorised;
  • fraud or misuse is reasonably suspected; or
  • we are unable to lawfully supply the product.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled order to the original payment method, subject to any rights and remedies that apply under Australian law.

We may apply reasonable quantity limits where necessary to manage availability, promotions, suspected misuse or other legitimate operational concerns.

8. Personal and Commercial Purchases

Unless we have expressly agreed otherwise, products purchased through the website are intended for personal or household use.

We may apply reasonable purchasing or quantity limits where necessary to manage availability, promotions, suspected misuse or other legitimate operational concerns.

Nothing in this section prevents a customer from exercising any rights available under applicable law.

9. Order Changes and Cancellations

Cancellation or order-change requests may be submitted within 24 hours after the order is placed.

We will make reasonable efforts to accommodate a request received within that period. However, a request may not be able to be changed once processing or dispatch has commenced.

After the 24-hour period, an order may only be cancelled or changed where permitted by SheSaid's policies or applicable law, including where the Australian Consumer Law provides a right to cancel.

Requests to change a delivery address are treated as order-change requests. Customers are responsible for providing an accurate delivery address and should contact SheSaid promptly if an address issue is identified.

10. Shipping and Delivery

Our Shipping & Delivery Policy forms part of these Terms and explains current processing times, delivery estimates, tracking, delivery issues and other shipping information.

Orders are generally prepared for dispatch within an estimated 1–2 business days.

Standard Australian delivery is generally estimated at 3–5 business days after dispatch, Monday to Friday.

Delivery estimates exclude weekends and public holidays and are estimates rather than guarantees.

Tracking information is provided by email after dispatch.

Delivery may be affected by carrier disruption, weather, customs or other events outside our reasonable control.

Nothing in this section excludes or limits any rights or remedies available under applicable law.

11. Refunds, Returns, Exchanges and Consumer Guarantees

Our Refund & Returns Policy forms part of these Terms.

It explains our voluntary 30-day change-of-mind return process and our process for faulty, damaged, incorrect, missing or otherwise affected products.

The 30-day change-of-mind return option is separate from rights and remedies available under the Australian Consumer Law and is subject to the conditions in our Refund & Returns Policy.

Australian Consumer Law rights apply automatically where the law provides them.

Depending on the nature of a problem, a customer may be entitled to a repair, replacement, refund, cancellation or compensation as provided by law.

We do not impose a blanket “No Refunds” or “All Sales Final” rule where doing so would remove or reduce rights provided by law.

The ACCC confirms that consumer guarantees apply automatically to most purchases, including online purchases, and businesses cannot remove those rights through their own terms or refund policies.

12. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, if a product has a major failure, you may be entitled to a replacement or refund and compensation for reasonably foreseeable loss or damage.

If a product fails to meet a consumer guarantee but the failure is not a major failure, you may be entitled to have the product repaired or replaced.

Nothing in these Terms, our policies or our communications is intended to exclude, restrict or modify any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified.

13. Warranty and Product Guarantees

Where SheSaid provides a voluntary warranty or product guarantee, it is additional to your rights under the Australian Consumer Law and does not replace or reduce those rights.

Any applicable warranty or product guarantee is governed by the terms provided with the product or in SheSaid's Warranty & Product Guarantee Policy.

Consumer guarantees are separate from voluntary warranties and cannot be removed or shortened by a voluntary warranty.

14. Promotions, Discounts and Offers

Promotions, discount codes, gifts, bundles and other offers may be subject to additional terms stated with the offer.

These may include:

  • eligibility requirements;
  • minimum spend requirements;
  • product exclusions;
  • usage limits; and
  • expiry dates.

Unless otherwise stated, promotional codes cannot be exchanged for cash and cannot be combined with other offers.

We may correct an obvious promotional error or withdraw an offer that was displayed incorrectly, subject to applicable law.

Promotional terms will not be used to remove or reduce rights you have under the Australian Consumer Law.

15. Reviews, Photos and User Content

If you submit a review, photograph, testimonial, comment or other content to SheSaid, you confirm that you have the necessary rights to submit it and that the content is not unlawful, misleading, defamatory, infringing or otherwise inappropriate.

Where you provide content for publication, you give SheSaid permission to use, reproduce, display and publish that content for the purposes for which it was submitted and for reasonable related website or marketing purposes, subject to applicable law and any specific permission or limitation communicated to you.

We may moderate, remove or decline to publish content where reasonably necessary.

Reviews should reflect genuine customer experiences, and we will not require a customer to provide a positive review as a condition of receiving a benefit.

16. Intellectual Property

The SheSaid name, branding, logos, website design, text, graphics, photographs, product presentation and other website content are owned by or licensed to SheSaid and are protected by applicable intellectual property laws.

You may view and use the website for personal, non-commercial shopping purposes.

You must not reproduce, modify, distribute, publish, sell, create derivative works from or commercially exploit SheSaid content without prior written permission, except where permitted by law.

Nothing in these Terms grants you ownership of or a licence to SheSaid's intellectual property except as expressly stated.

17. Third-Party Services, Tools and Links

The website may rely on third-party services for:

  • payment processing;
  • website functionality;
  • delivery;
  • communications;
  • analytics;
  • advertising;
  • customer support;
  • fulfilment; and
  • other business functions.

Some third-party tools or features may be made available through the website.

Third-party services and tools may have their own terms and privacy policies, and SheSaid does not control all aspects of those services.

The website may also contain links to third-party websites.

Those websites are not controlled by SheSaid, and you should review their terms and privacy practices before using them.

Nothing in this section limits any rights you have under applicable law.

18. Shopify Platform

SheSaid's online store is powered by Shopify, which provides technology and services that help us operate the website and provide our Services.

Your purchase of products is a transaction between you and SheSaid. Shopify provides the technology platform supporting our store but is not the seller of SheSaid's products.

Shopify may separately process personal information in connection with providing its services to SheSaid and operating the Shopify platform.

Our Privacy Policy explains more about the role of Shopify and other service providers in processing personal information.

Nothing in this section excludes, restricts or modifies any rights or remedies available to you under applicable law.

19. Privacy

Our Privacy Policy explains how SheSaid collects, uses, stores and discloses personal information and how you can make privacy requests or complaints.

Where applicable, SheSaid will handle personal information consistently with the Privacy Act 1988 (Cth), the Australian Privacy Principles and other privacy requirements that apply to the business and transaction.

Our Privacy Policy also explains our use of Shopify and other service providers and our approach to overseas processing and disclosure.

The OAIC's current guidance identifies matters including the kinds of personal information collected, how it is collected and held, purposes of use/disclosure, access and correction, complaints and overseas disclosures as key matters for an APP Privacy Policy.

20. Website Availability, Errors and Updates

We aim to keep our website available and information accurate, but temporary interruptions, maintenance, technical errors or inaccuracies may occur.

We may update, correct or improve website content from time to time.

This may include correcting errors or omissions relating to:

  • product descriptions;
  • pricing;
  • promotions;
  • product availability;
  • shipping information;
  • delivery estimates; or
  • other website information.

Where an obvious error materially affects an order, we may contact you and, where permitted by law, take reasonable steps to correct the error or cancel the affected order and provide any applicable refund.

Nothing in this section limits any right or remedy that you have under the Australian Consumer Law or other applicable law.

21. Automated Tools and AI Agents

We may use technical measures to manage automated access to the website.

You must not use bots, automated systems, AI agents or other software to:

  • scrape or systematically extract website content;
  • circumvent security measures;
  • bypass CAPTCHA or similar protections;
  • interfere with website operation;
  • impersonate human users;
  • circumvent access restrictions; or
  • access the website in a manner that causes unreasonable load, disruption or security risk.

Where we identify automated access that threatens the security, availability or integrity of the website, we may restrict or block that access.

This section does not prohibit ordinary technologies used by search engines, accessibility tools or other services where their use is permitted by applicable law and does not interfere with the operation or security of our website.

22. Prohibited Uses and Site Security

In addition to the restrictions elsewhere in these Terms, you must not use the website:

  • for unlawful or malicious purposes;
  • to transmit malicious code;
  • to collect personal information about other users without authorisation;
  • to send spam or phishing communications;
  • to impersonate another person or entity;
  • to infringe another person's intellectual property or other rights;
  • to interfere with or circumvent security or access controls;
  • to systematically copy, reproduce, resell or commercially exploit the website without permission; or
  • in a way that may harm SheSaid, our customers, service providers or the operation of the website.

We may suspend or restrict access where reasonably necessary to protect the website, customers, payment systems or our business.

23. Events Outside Our Reasonable Control

To the extent permitted by law, SheSaid is not responsible for delay or failure caused solely by circumstances outside our reasonable control, such as:

  • carrier disruption;
  • severe weather;
  • telecommunications outages;
  • natural disasters;
  • government restrictions;
  • customs delays; or
  • other external events.

This section does not exclude or limit any obligation, liability, guarantee or remedy that cannot lawfully be excluded or limited.

24. Limitation of Liability

To the maximum extent permitted by law, SheSaid will not be liable for loss or damage arising from your use of the website or services where that loss or damage was not caused by SheSaid's breach of these Terms, negligence, unlawful conduct or another matter for which liability cannot lawfully be excluded or limited.

Nothing in these Terms excludes, restricts or modifies:

  • Australian Consumer Law rights or guarantees;
  • liability that cannot legally be excluded or limited;
  • rights or remedies that cannot legally be excluded or limited; or
  • any other obligation imposed on SheSaid by applicable law.

Where liability can lawfully be limited, any limitation will apply only to the extent permitted by law.

25. Indemnity

To the extent permitted by law, you are responsible for losses or claims arising directly from:

  • your unlawful misuse of the website;
  • your infringement of a third party's rights through content you submit; or
  • your material breach of these Terms.

Nothing in this section requires you to indemnify SheSaid for matters caused by SheSaid's own unlawful conduct, breach of these Terms or obligations that cannot lawfully be transferred to you.

26. Termination or Restriction of Access

We may suspend or terminate your access to the website where reasonably necessary because of:

  • serious or repeated breaches of these Terms;
  • unlawful activity;
  • fraud or suspected fraud;
  • misuse of the website;
  • security threats; or
  • other circumstances where restriction is reasonably necessary to protect SheSaid, our customers or our services.

Termination or restriction of access does not affect rights or obligations that have already accrued or any rights that cannot lawfully be excluded.

27. Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will apply to the maximum extent permitted by law and, if necessary, will be severed to the extent it cannot be enforced.

The remaining provisions will continue to operate to the extent permitted by law.

28. Waiver and Entire Agreement

The failure of SheSaid to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies and additional terms expressly incorporated into them, form the agreement governing your use of the website and your purchases from SheSaid, subject to any rights that cannot lawfully be excluded.

Where a specific promotion, product or service has additional terms, those terms apply to the relevant promotion, product or service.

Nothing in this section prevents rights or remedies that arise under applicable law.

29. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where permitted by law.

SheSaid may transfer or assign its rights and obligations in connection with a sale, restructuring or transfer of the business, subject to applicable law and without reducing rights that have already accrued to you.

30. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

  • our products;
  • services;
  • website;
  • legal requirements;
  • technology; or
  • business operations.

The version published on the website applies from its stated effective date.

Changes will not retrospectively remove rights or remedies that have already accrued under applicable law or under a contract already formed, unless the law permits otherwise.

Where required by law, we will provide appropriate notice of material changes.

31. Governing Law and Disputes

These Terms are governed by the laws of Tasmania and the applicable laws of the Commonwealth of Australia, to the extent applicable.

If you have a concern about an order, product or service, please contact SheSaid first so that we can try to resolve the issue promptly.

Nothing in these Terms prevents you from exercising rights or pursuing remedies available under Australian law.
